1 IntroductionThis website enables estate agents to publicise and market their listings of available properties, and allows users of the website to browse the listings of available houses.2 Definitions2.1 “Estate Agent” means estate agents which upload their listings of available houses onto the Website;2.2 “Property” means any immovable property listed by an Estate Agent on the Website and which may be viewed by Users;2.3 “Property Burst” means Property Burst Trust IT 126/2012;2.4 “Terms and Conditions” means these terms which regulate a Users use of the Website;2.5 “User” means any person who uses the Website for any reason including an Estate Agent;2.6 “Website” means the Property Burst Trust website with URL www.propertyburst.co.za3 Estate Agents3.1 Property Burst is not an Estate Agent.3.2 The Website contains information and advertisements uploaded by Estate Agents. Property Burst is independent of all Estate Agents and does not have any partnership, joint venture or agency relationship with any Estate Agent. The Website does not convey or involve buying, selling, leasing or development of Property and Property Burst is not an agent, buyer, seller or developer of any Property.3.3 Property Burst is not responsible for any agreements, nor will it have any connection to agreements concluded between Users and Estate Agents or Users and buyers or sellers of Properties.4 Use of the Website and these Terms of Use4.1 Use of this Website constitutes a User’s acceptance of these Terms of Use. If a User does not agree to be bound by these Terms of Use, they may not use the Website.4.2 Please make yourself familiar with these terms and conditions, and check them regularly for any updates.4.3 Nothing on this Website constitutes an offer or contract of any sort by Property Burst in respect of any Property.5 Content of the Website5.1 The information contained on the Website is uploaded by the Estate Agents and not by Property Burst. Property Burst makes the content available as provided to it and does not verify its accuracy or completeness. The User is responsible for verifying information presented on the Website and Property Burst is not responsible for any mistakes or errors contained in the information provided on the Website.5.2 Any complaints by Users regarding a Website’s content will be investigated. Any further action taken by Property Burst is within its sole discretion and no further correspondence will be entered into by Property Burst with a User.5.3 Property Burst does not warrant that the Website is free from all errors and viruses or any other harmful software or devices that have the ability to corrupt a User’s computer.6 Prohibitions6.1 Users may not:(1) upload any files to the Website.(2) use any automatic software or device or a manual process to monitor or reproduce any part of the Website.(3) interfere with the proper working of the Website or impose a large load onto the Website.(4) copy, reproduce, alter, modify, or create a derivative work from the content displayed on the Website without Property Burst’s prior written consent.(5) attempt to reverse engineer the Website or use any other methods to attempt to find the source code of the Website.7 Intellectual property7.1 The Property Burst name and trademark and all content of the Website is the intellectual property of Property Burst or, in the case of content relating to Properties, of Estate Agents.7.2 Users have and will acquire no intellectual property rights in the Website or any of its content. The Website and its contents may not be used for any purpose other than obtaining the information regarding Properties available on the Website.8 Availability8.1 Property Burst will take reasonable steps to ensure that the Website is continuously available but cannot guarantee continuous availability. The Website may be unavailable for time to time for reasons including, without limitation, failure of networks, planned and unplanned maintenance and the activities of internet hackers. Property Burst bears no liability resulting from the unavailability of the Website for any reason.8.2 Property Burst will not be liable in any way for to any third parties, Users and Estate Agents arising out of in any way connected to the use of the Website, inability to use the Website, and any operational failure of the Website.9 Privacy9.1 Users may be requested to register with the Website and will be required to provide certain personal information to do so. Property Burst will use personal information of Users only for purposes connected to the Website and will not divulge that information to third parties. The Website may, however use cookies to collect information about a User’s use of the Website which does not identify a User personally. Users may turn off cookies in their internet browsers.9.2 If a User contacts an Estate Agent using information contained on the Website, Property Burst has no control over the Estate Agent’s treatment of any personal information disclosed. Property Burst is not responsible and bears no liability for the disclosure by the Estate Agent of any User’s personal information disclosed to the state Agent.10 Links to other internet websitesThe Website may contain links to other internet websites. Property Burst does not check the content or security of those websites and advises User’s to exercise their discretion when linking to other websites and to review the privacy policies and terms of use applicable to those websites. Use of those websites is at the User’s sole risk.11 LiabilityProperty Burst is not liable for any losses or damages suffered by a User arising from or connected to the User’s use of the Website or personal information provided by the User and the User indemnifies Property Burst against any such loss or damage.12 Jurisdiction12.1 These Terms and Conditions are governed by the law of South Africa.
